These Fairprogram.org Terms of Use and the Fairprogram.org Privacy Policy are effective as of July 5, 2018. Your continued use of the Services constitutes your acceptance of these updated policies.

PLEASE NOTE: THIS AGREEMENT CONTAINS A BINDING AND FINAL ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 14). PLEASE READ THESE TERMS CAREFULLY. BY ENTERING INTO THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU UNDERSTAND THIS AGREEMENT (INCLUDING THE DISPUTE RESOLUTION AND ARBITRATION PROVISIONS IN SECTION 14) AND AGREE TO ALL OF ITS TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MAY NOT USE OR ACCESS THE SERVICES.

These Terms of Use (“Terms”), which include the  Fairprogram.org Privacy Policy, serve as the "Agreement" between you and Fairprogram.org regarding the Services, and provide important information to you, including information about your obligations when using the Services, about content you access through the Services, about content you contribute to the Services, and about the limits of our liability to you. By accessing, downloading, or using any portion of the Services, you signify that you accept the terms of the Agreement. If you do not accept, then please do not use the Services.

How Fairprogram.org May Communicate with You


For purposes of responding to you and providing you with information and notices about your account or the Services (such as information about homes you might be interested in), you agree that Fairprogram.org may communicate with you, including through automated systems such as an automatic telephone dialing or text messaging system, using the contact information associated with your account, including your device ID, email, mobile number, telephone, or the postal address you provided (if any).  

 

Third Party Sites and Linked Materials

 

Fairprogram.org includes links to third party websites (“Third Party Sites”). You should review any applicable terms or privacy policy of a Third Party Site before using it or sharing any information with it, because you may give the third-party permission to use your information in ways we would not. Fairprogram.org is not responsible for and does not endorse any features, content, advertising, products or other materials on or available from Third Party Sites.

Rules and Logistics Governing Arbitration

 

The arbitration shall be conducted through JAMS before a single neutral arbitrator mutually selected by the parties, or, if they cannot agree, pursuant to JAMS Streamlined Arbitration Rules and Procedures (“JAMS Rules”). The arbitrator shall also have the sole and exclusive authority to determine the enforceability, interpretation, and implementation of this Agreement, as well as the arbitrability of disputes under this Agreement, except that the enforceability and interpretation of the Class Action Waiver shall be decided solely by a court of law having jurisdiction over the issue. The arbitrator shall issue a written decision that contains the essential findings and conclusions on which the decision is based.
